House Legislation to Sue Obama’s Executive Branch for Abuse of Power

A group of GOP House members says that it is time to draw a line in the sand in regards to the actions of the Hussein Obama administration.

Rep Trey Gowdy of South Carolina is interviewed regarding this position held a number of lawmakers and he provides insights as to why he and others believe that the lawlessness and overreach of the current regime has reached the point where action is required.

A House resolution has been brought up that would authorize a lawsuit against the executive branch.

The interviewer, Shannon Bream, offers her initial question regarding a decision in 2011 that members of Congress don’t have standing to sue the executive branch. That lawsuit was filed by Rep Dennis Kucinich over the war in Libya.

Gowdy, a former federal prosecutor of 16 years, confirms that the court ruling found that an individual congressman does not have standing. He explained that there is precedent which could indicate that the body of Congress, as a whole, is a different matter. Under the system of co-equal branches of government, the act of one branch to arbitrarily nullify the constitutionally granted powers of another branch may well be something upon which the court will decide that congress, as a body, does have standing.

Issues specifically addressed in the resolution are the administrative fix of cancelled policies in the obamacare rollout, the one year delay in the employer mandate, as well as an immigration decision and policy which halts enforcement of aspects of federal immigration law.

A simple majority vote along with a decision from Speaker Boehner to pursue it would be required to get the legal challenge into motion.

Gowdy offers some excellent explanations as to the particulars on the violations of law and the overreach, and he also asks an interesting question as to what happens if the president decided he didn’t want to enforce election laws.

Rep Gowdy closes by saying that the disrespect for the law and the Constitution has reached an unprecedented level and “we’ve got to do something about it.”
